This Refund, Cancellation, and Postponement Policy (this "Policy") is operated by CW Talent Group, LLC d/b/a CWTix™ ("CWTix™", "we", "us", or "our"). It explains when and how you ("you" or the "ticket buyer") may be entitled to a refund for a Ticket purchased through the CWTix™ Platform.
This Policy is incorporated by reference into, and forms part of, the CWTix™ Terms of Service (the "Terms"). Capitalised terms used but not defined in this Policy have the meanings given to them in the Terms, including "Organizer", "Ticket", "Total Price", "Platform", and "Event". If there is any conflict between this Policy and the Terms, the Terms govern, except that nothing in this Policy or the Terms limits any right you have that cannot be waived under applicable law.
Please read Section 10 (Your Rights Under New York Law) carefully. It describes mandatory refund rights that apply when an Event is cancelled, regardless of any Organizer policy or the general all-sales-final rule set out below.
1. CWTix™'s Role (Platform, Not Producer; Facilitates vs Funds)
CWTix™ is a ticketing platform and technology provider. We provide the technology that allows Organizers to list, sell, and manage tickets to their Events, and that allows you to buy those Tickets. We are not the producer, promoter, host, or operator of any Event.
The Organizer (and, where applicable, the venue) — not CWTix™ — is responsible for the Event, including whether it takes place, and sets the refund policy that applies to your Ticket. The Organizer, not CWTix™, FUNDS any refund.
CWTix™ FACILITATES refunds. This means that, where a refund is due under the Organizer's policy or applicable law, we process that refund on the Organizer's behalf through our payment processor. We do not fund refunds out of our own money, and our role is limited to facilitating the refund through the payment processor.
This distinction matters throughout this Policy: the Organizer determines whether a refund is due and provides the funds for it, while CWTix™ facilitates the processing of any refund that is due.
2. General Rule — All Sales Final
Except as otherwise provided in this Policy, all Ticket sales are final, and Tickets are non-refundable and non-exchangeable.
This general rule applies unless the Organizer's refund policy for your Event provides otherwise, or applicable law (including the New York Arts and Cultural Affairs Law described in Section 10) requires otherwise. Where the Organizer's policy or applicable law provides for a refund, that refund will be made in accordance with this Policy.
3. Cancelled Events
If an Event is cancelled, you are entitled to a refund of the amount you paid for your Ticket, as required by the Organizer's policy and applicable law.
Any such refund is funded by the Organizer. CWTix™ will facilitate the processing of the refund through our payment processor in accordance with Section 8.
You do not normally need to take any action to receive a refund for a cancelled Event, but if you have not received your refund within the timeframe described in Section 6, please contact us using the details in Section 11.
4. Postponed or Rescheduled Events
If an Event is postponed or rescheduled to a new date, your Ticket typically remains valid for the new date, and no further action is required to use it.
Whether a refund is available for a postponed or rescheduled Event depends on the Organizer's policy and applicable law. Some Organizers offer refunds for postponed or rescheduled Events; others do not.
Where a refund is available under the Organizer's policy or applicable law, it is funded by the Organizer, and CWTix™ will facilitate the processing of the refund in accordance with Section 8.
5. Materially Changed Events
If an Event is materially changed — for example, through a significant change to the venue, date, or lineup — the availability of a refund is determined in accordance with the Organizer's policy and applicable law.
What counts as a "material" change, and whether such a change entitles you to a refund, is set by the Organizer's policy and applicable law. Where a refund is due, it is funded by the Organizer, and CWTix™ will facilitate the processing of the refund in accordance with Section 8.
6. How to Request a Refund and Processing Timeframe
To request a refund, please submit your request to us at support@GetCWTix.com or through the contact form at https://www.getcwtix.com/contact. Please include your order number and the name of the Event so that we can locate your purchase.
For cancelled Events, refunds are typically issued or processed within the timeframe communicated by the Organizer following the cancellation announcement or approval of your refund request, subject to the Organizer's policy and applicable law.
Processing timeframes for postponed, rescheduled, or materially changed Events depend on the Organizer's policy and on when the Organizer approves and funds the refund.
The timing of when the refunded amount appears in your account also depends on your payment processor and card issuer, as described in Section 8.
7. No CWTix™ Fan Fees to Refund
CWTix™ charges fans no fees of any kind. Because there are no CWTix™ fan service fees, there are no CWTix™ service fees to refund.
Any refund under this Policy is a refund of the amount you paid for the Ticket, plus any refundable taxes or other charges as applicable and as required by the Organizer's policy and applicable law.
8. How Refunds Are Issued
Refunds are issued to the original payment method used for your purchase, through the original payment processor.
The timing of a refund may depend on your payment processor and your card issuer or bank. CWTix™'s role is limited to facilitating the refund through the payment processor; once the refund has been processed, the time it takes to appear in your account is determined by the processor, card issuer, or bank.
If your original payment method is no longer valid or available, please contact us using the details in Section 11 so that we can assist with processing your refund.
9. Chargebacks and Disputed Transactions
If you believe you are entitled to a refund, please contact CWTix™ and/or the Organizer first, using the details in Section 11, before initiating a chargeback or payment dispute with your card issuer or bank. In most cases we can resolve the matter directly.
Initiating a chargeback on a valid, non-refundable purchase may be treated as a disputed transaction and may result in suspension of your account.
As described throughout this Policy, CWTix™'s role is limited to facilitating refunds through the payment processor. The Organizer determines whether a refund is due and funds any refund.
10. Your Rights Under New York Law (Arts and Cultural Affairs Law)
This Section overrides the rest of this Policy. If an Event is cancelled, you have mandatory refund rights under the New York Arts and Cultural Affairs Law. These rights apply REGARDLESS of any Organizer policy and REGARDLESS of the general all-sales-final rule in Section 2.
Nothing in this Policy, and nothing in the Terms, limits, waives, or reduces any right that cannot be waived under applicable law, including your mandatory refund rights on cancellation under the New York Arts and Cultural Affairs Law.
To the extent any provision of this Policy conflicts with a right that cannot be waived under applicable law, that provision does not apply to you to the extent of the conflict, and your non-waivable rights prevail.
