CWTix™ Privacy Policy

CW Talent Group, LLC, doing business as CWTix™ ("CWTix™", "we", "us", or "our"), respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit our websites, use our ticketing platform and related services, purchase or receive tickets, or otherwise interact with us (together, the "Platform").

This Privacy Policy applies to you as an end user, website visitor, or ticket purchaser ("you" or "your"). By using the Platform, you acknowledge that you have read and understood this Privacy Policy. Your use of the Platform is also governed by the CWTix™ Terms of Service and, where applicable, the CWTix™ Refund Policy, which are incorporated here by reference.

This Privacy Policy does not cover the privacy practices of event organizers, venues, payment processors, or other third parties whose services you may access through or alongside the Platform. We encourage you to review the privacy policies of those third parties directly.

We collect the following categories of personal information, depending on how you interact with the Platform:

1. Account information — the information you provide when you create or manage an account, such as your name, username, password, and account preferences.
2. Contact details — your email address, postal address, telephone number, and similar information you provide so that we can communicate with you and deliver your tickets.
3. Payment information — information needed to process your purchases. Payments are processed through our third-party payment processors, Stripe and PayPal. We do not store full payment card numbers; our payment processors handle and store card data in accordance with their own security standards and privacy practices. We may retain limited transaction details, such as the last four digits of a card, the transaction amount, and a confirmation reference.
4. Device and usage data — information about the device and software you use and how you interact with the Platform, such as your IP address, browser type, operating system, device identifiers, pages viewed, links clicked, referring pages, and the dates and times of your visits.
5. Cookies and similar technologies — information collected through cookies, pixels, tags, software development kits, and similar technologies, as described in Section 6.

We collect personal information in three main ways:

1. Directly from you — when you create an account, purchase or request tickets, contact customer support, sign up for communications, respond to surveys, or otherwise provide information to us.
2. Automatically — when you use the Platform, we and our service providers automatically collect device and usage data through cookies and similar technologies, as described in Sections 2 and 6.
3. From third parties — we may receive information about you from event organizers and venues for the events you attend, from our payment processors, and from analytics providers, advertising partners, and other service providers who help us operate and improve the Platform.

We use personal information for the following purposes:

1. Processing and fulfilling ticket purchases, including verifying your purchase, processing payment, and confirming your order.
2. Delivering tickets to you and providing access to the events you purchase.
3. Providing customer support and responding to your questions, requests, and complaints.
4. Detecting, preventing, and investigating fraud, abuse, security incidents, and other harmful or unlawful activity.
5. Communicating with you, including sending transactional messages (such as order confirmations, ticket delivery, and service notices) and, with your consent where required by law, marketing communications about events, offers, and updates.
6. Operating, maintaining, analyzing, and improving the Platform and our services.
7. Complying with our legal obligations, enforcing our agreements, and protecting our rights and the rights, safety, and property of others.

We share personal information with the following categories of recipients:

1. Payment processors — we share payment and transaction information with Stripe and PayPal to process your purchases.
2. Event organizers and venues — we share information with the organizers and venues for the events you buy tickets to, limited to what is needed to fulfill and manage your purchase and your attendance at that event.
3. Service providers and vendors — we share information with companies that perform services on our behalf, such as hosting, data storage, analytics, customer support, communications, and security, subject to obligations to protect the information.
4. Legal, safety, and law-enforcement disclosures — we may disclose information when we believe in good faith that disclosure is necessary to comply with a legal obligation, respond to lawful requests from public authorities, enforce our agreements, or protect the rights, safety, and property of CWTix™, our users, or others.
5. Business transfers — if we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, personal information may be transferred as part of that transaction, subject to this Privacy Policy or a successor policy.

We do NOT sell your personal information, and we do NOT share your personal information for cross-context behavioral advertising.

We and our service providers use cookies and similar tracking technologies to operate, secure, analyze, and improve the Platform. These technologies fall into the following categories:

1. Essential cookies — necessary for the Platform to function, such as enabling you to log in, maintain a session, and complete a purchase.
2. Functional cookies — used to remember your preferences and settings and to personalize your experience.
3. Analytics cookies — used to understand how visitors use the Platform so that we can measure and improve its performance.
4. Advertising cookies — where used, these support advertising and measurement. As stated in Section 5, we do not share personal information for cross-context behavioral advertising.
5. As of the Effective Date, CWTix™ does not use any third-party analytics or advertising tracking technologies on the Platform. In the future, we may implement analytics tools (such as Google Analytics) and product-experience or session-replay tools (such as Smartlook) to help us understand how the Platform is used and to improve the user experience. If and when we enable any such tools, we will update this Privacy Policy to describe the technologies in use, the information they collect, and the purposes for which we use them, and we will provide any required opt-out mechanisms or cookie controls before or at the time such tools are enabled. For the avoidance of doubt, as stated in Section 5, we do not sell your personal information and we do not share your personal information for cross-context behavioral advertising, and the future use of any such tools will not change that position.

You can control cookies through your browser settings and through our cookie-settings tool, available at the Cookie Preferences link in the website footer. Disabling certain cookies may affect the functionality of the Platform.

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we process the information and whether we can achieve those purposes through other means; our legal, accounting, tax, and reporting obligations; and the need to resolve disputes, prevent fraud, and enforce our agreements. When personal information is no longer needed, we securely delete, anonymize, or de-identify it.

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, loss, or destruction. These measures include access controls, encryption in transit where appropriate, and ongoing monitoring of our systems. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee the absolute security of your information.

Depending on where you live and the laws that apply to you, you may have the following rights regarding your personal information:

1. Access — the right to request access to the personal information we hold about you.
2. Correction — the right to request that we correct inaccurate or incomplete personal information.
3. Deletion — the right to request that we delete your personal information, subject to legal exceptions.
4. Portability — where applicable, the right to receive a copy of certain personal information in a portable format.
5. Opt-outs and preferences — the right to opt out of certain processing and to manage your communication and marketing preferences.

We maintain a reasonable data security program that includes administrative, technical, and physical safeguards to protect the private information of New York residents, consistent with the New York Stop Hacks and Improve Electronic Data Security (SHIELD) Act, General Business Law Section 899-bb. In the event of a breach of the security of the system involving the private information of New York residents, we will provide notification to affected individuals as required by General Business Law Section 899-aa.

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"), provides you with specific rights regarding your personal information. This Section describes those rights and how to exercise them.

11.1 Categories of Personal Information

The following table describes the categories of personal information we have collected, the sources of that information, the business and commercial purposes for which we use it, and the categories of third parties to whom we disclose it.

We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising. Accordingly, in the preceding 12 months we have not sold or shared (as those terms are defined under the CCPA) the categories of personal information listed above.

11.2 Your California Rights

Subject to certain exceptions, California residents have the following rights:

1. The right to know and access — the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we share it.
2. The right to delete — the right to request that we delete personal information we have collected from you.
3. The right to correct — the right to request that we correct inaccurate personal information we maintain about you.
4. The right to opt out of sale or sharing — the right to opt out of the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising. As stated above, we do not sell or share your personal information; we nonetheless provide a "Do Not Sell or Share My Personal Information" mechanism at https://www.getcwtix.com/contact.
5. The right to limit the use of sensitive personal information — to the extent we use sensitive personal information for purposes that trigger this right, you may request that we limit our use of it to those purposes permitted under the CCPA.
6. The right to non-discrimination — we will not discriminate against you for exercising any of your CCPA rights.

11.3 How to Submit a Request

To submit a request to know, delete, correct, or opt out, contact us at info@CWTalentGroup.com or submit a request at https://www.getcwtix.com/contact. You may also use an authorized agent to submit a request on your behalf, in which case we may require the agent to provide proof of authorization and may require you to verify your identity directly. To protect your information, we will take steps to verify your identity before fulfilling a request, which may include matching information you provide with information we maintain. We will respond within the timeframes required by the CCPA.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the following additional information applies to our processing of your personal information under the General Data Protection Regulation and equivalent UK and Swiss laws.

12.1 Controller

CW Talent Group, LLC d/b/a CWTix™ is the controller responsible for your personal information. You can contact us using the details in Section 15.

12.2 Legal Bases for Processing

We process your personal information on the following legal bases:

1. Performance of a contract — to process and fulfill your ticket purchases and provide the Platform to you.
2. Legitimate interests — to operate, secure, analyze, and improve the Platform, prevent fraud, and communicate with you, where our interests are not overridden by your rights and interests.
3. Consent — where we rely on your consent, such as for certain marketing communications and certain cookies; you may withdraw your consent at any time.
4. Legal obligation — to comply with our legal and regulatory obligations.

12.3 Your Rights

Subject to applicable law, you have the right to access, rectify, erase, and restrict the processing of your personal information; the right to data portability; the right to object to certain processing; the right to withdraw consent where processing is based on consent; and the right to lodge a complaint with a supervisory authority in your country of residence, place of work, or place of the alleged infringement.

12.4 International Data Transfers

We may transfer your personal information to, and process it in, countries other than the one in which you reside, including the United States. Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland to a country that has not been deemed to provide an adequate level of protection, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses and, where applicable, the UK International Data Transfer Agreement or Addendum.

The Platform is not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information. If you are a parent or guardian and believe that your child under 13 has provided personal information to us, please contact us at info@CWTalentGroup.com so that we can take appropriate action.

We may update this Privacy Policy from time to time. When we make changes, we will revise the "Effective Date" at the top of this Privacy Policy and, where required by law or where the changes are material, we will provide additional notice, such as by posting a notice on the Platform or sending you a communication. We encourage you to review this Privacy Policy periodically. Your continued use of the Platform after the Effective Date of an updated Privacy Policy constitutes your acceptance of the updated policy to the extent permitted by law.
